To clarify, it is not Instagram which is attempting to grab rights to photographs posted there. Rather it is a company that really should know better, Hilton Hotels, which is audaciously trying to get hold of an image for unrestricted use without any form of payment. As the story makes clear, not only could Hilton Hotels licence the image to others for its own gain on a commercial basis, it also expects the photographer to indemnify it against any action arising from Hilton's use of it. All of which is totally outrageous and not particularly good PR if the story were to be more widely circulated. Alarmingly, all it would have taken was a simple response on the part of the photographer to surrender his rights.
